SHIPPING AND DELIVERY POLICY
General Tooba Furniture Factory, with its registered address at Sukoon Plaza, Nr Jafari Knowledge City, Vadnagar, Kheralu, Shekhpur, Gujarat - 384325 (“Tooba,” “we,” “us,” or “our”), manages and operates the mobile application/website www.tooba.in (collectively referred to as the “Tooba Digital Platform”). Through this platform, Tooba facilitates the sale and purchase of Furniture wood, Ply-based accessories, and other products (“Products”) for users of the Tooba Digital Platform (“User,” “Users,” “you,” or “your”).
This Shipping and Delivery Policy (“Policy”), in conjunction with the Terms, outlines our policies and procedures regarding the delivery and shipping of Products purchased on the Tooba Digital Platform.
We provide shipping and delivery of our Products across India. Our goal is to offer you the best customer experience by partnering with leading logistics service providers to ensure your orders are handled efficiently, providing you with a hassle-free experience when receiving the Products you've ordered from the Tooba Digital Platform. We make all commercially reasonable efforts to ensure the timely delivery of Products.
By agreeing to use the Tooba Digital Platform and/or purchasing a Product on it, you consent to be bound by the terms of this Policy without modification. We encourage you to read and understand the terms of this Policy each time you visit the Tooba Digital Platform. If you do not agree with the terms contained in this Policy, we advise you not to use, access, or transact on the Tooba Digital Platform.
Terms of Shipping and Delivery We collaborate with third-party logistics service providers to facilitate the shipping and delivery of Products to you ("Logistic Partners"). We will provide the details of the Logistic Partner responsible for processing the shipping and delivery of any purchased Product(s) on the Tooba Digital Platform when the Product is successfully handed over to the Logistic Partner by us. Our standard dispatch timelines depend on the delivery pin code. You can find estimated timelines on the ‘Product Detail Page’ by entering the relevant delivery pin code. In any case, users will be provided with an estimated timeline for the delivery of the purchased Product, which will be displayed on the ‘Product Detail Page’ at the time the order is confirmed by us. We will also share order details after dispatch via the email ID and/or mobile number provided by you or registered with us. Please note that while we primarily utilize Logistic Partners for Product delivery, we reserve the right to ship and deliver Products on our own without engaging Logistic Partners or third-party service providers.
You acknowledge that while we strive to ship and deliver our Products throughout India, we may, at our sole discretion, designate certain areas as unserviceable for Product delivery. In such cases, neither we nor our Logistic Partners will provide shipping and delivery services for those areas, and orders may not be processed on the Tooba Digital Platform. If an area is deemed unserviceable by us, we will notify users at the time of placing an order on the Tooba Digital Platform. You can also verify whether an area is unserviceable for deliveries by entering the relevant area pin code on the Tooba Digital Platform. Tooba Furniture Factory reserves the right to cancel your order if a Product is shipped and the pin code becomes unserviceable.
To ensure the timely delivery of purchased Products, we may request or collect specific information, such as your name, shipping address, billing address, landmarks, and contact details. It is essential that all information submitted by you on the Tooba Digital Platform is true, complete, accurate, and sufficient to identify the actual delivery location. You understand that you are solely responsible if we fail to deliver purchased Products due to incorrect, incomplete, or inaccurate information provided by you when placing the order. We shall not be liable for any issues arising from your failure to provide correct and complete information.
We will make every effort to deliver the purchased Product to your designated address within the estimated delivery timeline notified to you. If you are unavailable to accept the Product delivery, our Logistic Partners will make a maximum of 2 (two) delivery attempts. If the second delivery attempt is unsuccessful, and you remain unavailable, we reserve the right to cancel the order for the purchased Products at our sole discretion and initiate the return process. We also reserve the right to deduct the shipping and delivery charges incurred by us when processing refunds following such cancellation.
While we endeavor to ensure the timely delivery of purchased Products within the notified timeline, you acknowledge that delivery may be delayed due to:
- Logistical issues beyond our control
- Unsuitable weather conditions
- Political disruptions, strikes, employee lockouts, etc.
- Acts of God such as floods, earthquakes, etc.
- Other unforeseeable circumstances.
In the event of such delays, we will make a reasonable attempt to inform you via the email ID and/or mobile number registered with us. We disclaim all liabilities that may arise from our failure to inform you of delivery delays on the Tooba Digital Platform. Furthermore, we are under no obligation to compensate you for any claims arising from shipment, delivery, or use of purchased Products delayed due to the aforementioned reasons.
We strive to engage Logistic Partners, employees, and agents who uphold high standards of ethics and integrity, and we expect them to exhibit professionalism, competence, and courtesy. You understand and acknowledge that the actions or inactions of delivery personnel are beyond our control, and we cannot monitor each delivery executive. Since we facilitate the delivery of Products purchased by you, we are not liable for any actions or omissions by our delivery agents, employees, or personnel, or those of the Logistic Partner or their employees, agents, or personnel. This includes issues such as service deficiencies, incorrect Product deliveries, delivery times, Product package tampering, and more. It is important to note that any unprofessional behavior or discourtesy displayed by our delivery executives or the personnel of the Logistic Partners is beyond our control. Any disputes arising between you and our delivery executive or an employee, agent, or personnel of the Logistic Partner must be resolved independently. You agree and acknowledge that you will not hold us responsible or require us to mediate or resolve such disputes.
After placing an order on the Tooba Digital Platform, we process the order and hand over the purchased Product to our Logistic Partner. You will receive a unique tracking identity number once the purchased Product is handed over to the Logistics Partner, allowing you to track the delivery status. You can use the tracking identity number on the Tooba Digital Platform, the website, and/or the mobile application of the Logistic Partner to monitor the status and location of the purchased Product, as well as its estimated time of delivery. Our customer service team collaborates with Logistic Partners to ensure that Products are delivered to you as soon as possible, making every reasonable effort to update the tracking status of purchased Products in real-time. Please note that we engage third-party service providers for Product deliveries, and therefore, we cannot guarantee the accuracy or correctness of the tracking status, which may be subject to inconsistencies due to information updates and technical difficulties beyond our control.
Do not accept any package of the Product that appears visibly damaged, torn, or tampered with in transit, or if its seal has been tampered with. Acceptance of a tampered "Void Seal" or a “Damaged Package” disqualifies you from making claims for missing products, physically damaged/defective Products, incorrect Products, or missing accessories.
We reserve the right to charge or collect shipping fees on Products from time to time. Shipping charges may vary based on the value of the Product, type of Product, delivery area, payment method, and other factors. You agree that we are authorized to collect shipping and delivery fees on behalf of the Logistic Partner for the delivery service provided. If we charge shipping fees for a purchased Product's delivery, these fees will not be refunded by us following any return request you raise. However, we may make exceptions and refund the shipping fees in the event that a defective, damaged, deficient, or incorrect Product (for reasons attributable to us and accepted by us after due verification at our sole discretion) has been delivered. You acknowledge and accept that the title and risk of all Products ordered by you pass to you upon delivery.
Returns of purchased Products are facilitated through our reverse Logistics Partners. Upon receiving a request for the return of a Product on the Tooba Digital Platform, and after approval by us, our reverse Logistics Partners will contact you to arrange the collection of the purchased Products. We process returns and exchanges of purchased Products in accordance with our Return and Refund Policy.
